Chesapeake Lofts involves the conversion of a former warehouse right on Lake Erie to condominiums. An unusual construction with precast concrete and years of vacancy and the elements combined to make the original repairs and refurbishment of the building’s envelope a challenge, and two different roof contractors were originally engaged to make the required repairs.
Each contractor used different materials and methods to interpret the contract document and the brisk winds on the Lake exposed weaknesses in the respective materials and workmanship almost immediately, causing significant damage and water penetration.
Eberhard was consulted by the association’s legal counsel on the issues and standards in the industry to review the contract documents, tests of the roof construction and advise on the preparation of the complaint which resulted in a satisfactory settlement and appropriate repairs.
